Terms and Conditions
Love it or leave it customer promise
The promoter is Greystar Australia Pty Ltd (Greystar).
Greystar’s Haiku satisfaction guarantee (Guarantee) is designed to allow for an early termination of lease by an eligible resident at one of the following properties:
(a) Haiku, The Gladstone, South Melbourne
(b) Haiku, The Claremont, South Yarra
(c) Haiku, The Yarra, South Yarra,
(each a Haiku Property).
By participating in this Guarantee, the residents agree to the following terms and conditions:
Eligibility
1. The Guarantee is available to any individuals signing their first lease at a Haiku Property (Residents).
2. This Guarantee does not apply to individuals:
· who have previously entered into a lease at any Haiku Property;
· transferring from another Haiku property (for example, upgrading or downgrading apartments); or
· who are in breach of their lease or tenancy obligations for their current premises within another build-to-rent property owned or managed by a related entity of Greystar.
3. The Guarantee applies only to a lease with a term of 12-months or more.
Conditions
1. Following the entry into a lease (Lease) in respect of a premises at a Haiku Property (Premises), if the Residents are not satisfied with the Premises for whatever reasons, the Residents may terminate the Lease within the first 30 days from their lease commencement date in accordance with the conditions in this Guarantee.
2. The Residents must pay their first month’s rent and bond before moving in, in accordance with the terms and conditions of the Lease.
3. The Residents must provide a minimum 30-day written notice to Greystar (Termination Notice) and the Lease will be deemed to have terminated on the date that is 30 days after Greystar has received the notice (Termination Date).
4. Rent remains payable under the Lease from the lease commencement date until the Termination Date.
5. Rent is calculated daily, for the period the Residents occupied the apartment (from the lease commencement date to the Termination Date).
6. If the Residents give a Termination Notice, the Residents agree that they will not be entitled to any incentive paid or payable by Greystar under the Lease or other promotional offers, including any rent-free period the Residents may be entitled to prior to or after the Termination Date, and the Rent payable prior to the Termination Date under the Lease must be paid in full by the Residents prior to the Termination Date.
7. Transfers to another apartment within the same or any other Haiku Property are not permitted under this Guarantee.
8. Each Resident can only participate in this Guarantee once.
9. The Guarantee is not transferable and cannot be redeemed for cash.
10. Except otherwise provided in this Guarantee, the Residents are not relieved from performing any remaining obligations under the Lease, including any obligations by the Residents to make good the Premises when the Lease is terminated, and the terms and conditions of the Lease remain in full force and effect and continues to bind the Residents and Greystar.
Other rights
Nothing in these Terms affect rights of the Residents under their Leases or under the Residential Tenancies Act 1997 (Vic).
Final Decision
All decisions regarding eligibility are at Greystar’s sole discretion and are final.
Privacy
Greystar will collect, store, use and disclose the personal information of individuals participating in the Promotion in accordance with its Privacy Policy
