Terms & Conditions – "Find Love at The Claremont" Promotion
Promotion Overview:
The promoter is [Evolution BTR Pty Ltd (ACN 637 656 814) as trustee for Greystar Australia SY2 Trust] (Greystar).
Greystar’s ["Find Love at The Claremont"] Promotion (Promotion) is designed to celebrate connection and provide added flexibility for residents. In accordance with the below terms and conditions, if two residents currently residing at The Claremont wish to move in together, Greystar will allow them to break their existing leases without having to pay a break-lease fee and relocate to a Greystar-managed apartment that has an equivalent or higher rental value.
By participating in this Promotion, residents agree to the following terms and conditions:
Eligibility Criteria:
- Residency Requirement:
(a) Both individuals must:
(i) be current residents of separate premises within The Claremont (Residents) at the time they submit a request under this Promotion;
(ii) have lived at The Claremont for a minimum of 3 months immediately before submitting a request under this Promotion;
(iii) have complied with any and all of their obligations under their respective leases for their current premises within The Claremont (Existing Leases), including but not limited to their obligation to pay rent in accordance with the Existing Leases.
(b) This Promotion operates to break the lease fees for two Existing Leases of The Claremont and no more.
- Promotion Process:
(a) To participate in the Promotion, the Residents:
(i) must during the Promotion Term notify either Greystar’s Leasing Manager or Community Manager in writing of their intention to break their respective Existing Leases and cohabitate instead;
(ii) can only choose to cohabitate in either:
(A) the current premises of the Resident at The Claremont with the higher weekly rent (Higher Rent Apartment); or
(B) a new apartment within The Claremont offered to them by Greystar that has a weekly rent that is equal to or higher than that of the Higher Rent Apartment;
(iii) must notify Greystar in writing of their selected apartment chosen from the options at the above clause 2(a)(ii) (Selected Apartment);
(iv) must jointly sign the lease agreement provided to them by Greystar for the Selected Apartment for the following term:
(A) in the event that the Selected Apartment is the Higher Rent Apartment, the term remaining in the Existing Lease with the applicable Resident for the Higher Rent Apartment; or
(B) in the event that the Selected Apartment has been chosen in accordance with clause 2(a)(ii)(B), 12 months,
or such longer term as elected by the Residents; and
(v) must terminate their Existing Leases in accordance with the terms of the respective Existing Lease.
(b) In accordance with these Terms, if both Residents are eligible to participate in the Promotion in accordance with clause 1 and have complied with the promotion process outlined in this clause 2, Greystar will waive any break-lease fee associated with both of the Existing Leases.
Additional Conditions:
- Notice Period:
- Residents must provide a minimum of 28 days' written notice when requesting to break their leases under this Promotion.
- New Lease Agreement:
- The new lease must commence within 28 days of written notice being provided under clause 3 to ensure continuity.
Limitations & Exclusions:
- Offer Validity:
The Promotion commences on 9th April 2025 and expires on 6th October 2025]. (Promotion Term)
- One-Time Use:
Each Resident can only participate in this Promotion once.
- Additional Costs:
While Greystar will not seek to recover the break-lease fee associated with the early termination of the lease, Residents are responsible for any moving costs, bond payments, or additional fees required for their new apartment as well as any costs associated with rectifying damage to the current premises caused during the term of the Existing Lease.
General Conditions:
- Promotion Changes:
If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Greystar, Greystar may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
- Other rights:
Nothing in these Terms affect rights of the Residents under their respective Existing Lease or under the Residential Tenancies Act 1997 (Vic).
- Final Decision:
All decisions regarding eligibility and Promotion fulfillment are at Greystar’s sole discretion and are final.
- Privacy:
Greystar will collect, store, use and disclose the personal information of individuals participating in the Promotion in accordance with its Privacy Policy https://www.greystar.com/privacy/global-privacy-policy
